Abstract. Disruptive passenger incidents are an increasing concern in Nigerian aviation, raising difficult questions about the powers of airlines, the limits of passenger conduct, and the scope of constitutional rights. This article examines the legal framework governing passenger behaviour and airline responses, situating Nigerian law within international conventions, domestic statutes, and case law. It argues that while safety is paramount, enforcement actions must remain consistent with the principles of proportionality, fair hearing, and human dignity. The article concludes with recommendations for reform and remedies available to aggrieved passengers.

I. Introduction

Civil aviation requires order, compliance, and discipline. A single passenger’s refusal to obey crew instructions—whether to switch off a device or to remain seated—can disrupt operations and endanger lives. At the same time, the manner in which airlines and authorities respond to misconduct has profound implications for constitutional rights, public confidence, and the reputation of the industry.

Recent controversies in Nigeria, ranging from disputes over mobile phones to allegations of assault against crew, have brought these tensions to the fore. Some cases resulted in lifetime bans and viral humiliation; others in muted consequences for more influential individuals. This disparity has sparked debate about the fairness, legality, and proportionality of sanctions.

II. International Legal Framework

A. The Tokyo Convention 1963

The Convention on Offences and Certain Other Acts Committed on Board Aircraft (Tokyo Convention, 1963) empowers the Pilot-in-Command (PIC) to take reasonable measures, including restraint, where passenger conduct threatens safety or good order. Article 6 authorises the PIC to disembark or deliver disruptive passengers to competent authorities upon landing, while Article 10 provides immunity to airlines and crew for reasonable actions taken in good faith. B. The Montréal Protocol 2014

The Montréal Protocol 2014, adopted to amend the Tokyo Convention, expands jurisdiction to prosecute unruly conduct and strengthens penalties for serious incidents, including physical assault against crew. [2]

III. Nigerian Legal Framework

A. Civil Aviation Act 2022

The Act incorporates Nigeria’s treaty obligations and vests regulatory powers in the Nigerian Civil Aviation Authority (NCAA). It affirms the PIC’s authority to enforce discipline and permits measures necessary to ensure order. [3]

B. Nigeria Civil Aviation Regulations (NCAR), Part 17

Part 17 requires passengers to comply with lawful crew instructions and empowers airlines to remove or sanction those who refuse. It mirrors ICAO standards on unruly passengers. [4]

C. FAAN Bye-Laws

The FAAN Bye-Laws (2019) criminalise disorderly conduct within airports and aircraft, providing a statutory basis for Aviation Security (AVSEC) intervention. [5]

D. Nigerian Criminal Law

General offences such as assault and battery are punishable under the Criminal Code Act and the Penal Code Act. These statutes apply to aviation incidents unless expressly excluded. [11]

IV. Key Legal Issues in Passenger Misconduct

A. Compliance with Crew Instructions

Passengers are legally bound to obey crew instructions. Failure to comply—whether with phone restrictions, seatbelt orders, or other directives—constitutes unruly behaviour under NCAR. Importantly, only the crew has authority to enforce compliance; other passengers lack such powers, and interference may itself amount to trespass or assault.

B. Proportionality in Enforcement

International law requires that restraint be proportionate to the threat. Blocking a passenger’s exit post-landing without explanation, or using physical force that results in torn clothing or exposure, risks crossing the line into unreasonable or degrading treatment, potentially engaging constitutional protections.

C. Sanctions and the Right to Fair Hearing

While airlines may refuse carriage, indefinite or industry-wide bans imposed without a hearing are constitutionally suspect. Section 36 of the Constitution guarantees the right to fair hearing. Nigerian courts have held that administrative decisions affecting rights must observe due process, as in Ebhota v. Plateau State. [6] A lifetime ban announced by press release, without notice or opportunity to respond, may therefore be struck down as arbitrary.

D. Dignity of the Human Person

Section 34(1) guarantees freedom from inhuman or degrading treatment. Where passenger enforcement results in torn clothes, forced exposure, or viral humiliation, a breach may occur. In Uzoukwu v. Ezeonu II, the Court of Appeal affirmed that treatment which lowers human worth or subjects a person to ridicule violates constitutional dignity. [9]

E. Privacy and Data Protection

The Nigeria Data Protection Act 2023 prohibits unauthorised processing and disclosure of personal data. The recording and viral circulation of videos showing passengers in humiliating states may amount to statutory breaches. [7]

F. Equality Before the Law

Section 42 prohibits discriminatory treatment. The appearance of harsher sanctions against ordinary travellers but leniency toward influential individuals undermines public confidence and may be challenged as discriminatory.

V. Remedies Available to Passengers

  • Judicial Review of airline bans or NCAA enforcement actions lacking due process.
  • Fundamental Rights Enforcement under Sections 34 and 36 of the Constitution for degrading treatment or denial of fair hearing (Fawehinmi v. NBC). [10]
  • Civil Damages for assault, battery, trespass to property, or negligence in the course of enforcement.
  • Data Protection Complaints to the Nigeria Data Protection Commission for unauthorised video circulation.
  • Defamation Suits where reputational injury results from premature branding as “unruly” without thorough investigation.

VI. Recommendations for Reform

  • Codify Sanction Procedures: Statutory guidelines for airline sanctions, including hearings and appeal rights.
  • Ensure Consistent Enforcement: Sanctions should apply equally to all passengers, regardless of social standing.
  • Enhance Crew Training: Emphasise de-escalation and rights-sensitive conflict management.
  • Protect Passenger Privacy: Enforce strict policies against unauthorised filming and circulation of incidents.
  • Independent Oversight: NCAA review panels for passenger sanction disputes.

VII. Conclusion

The law recognises that passenger misconduct threatens aviation safety and authorises strong enforcement by airlines and authorities. Yet the same law insists that enforcement be proportionate, procedurally fair, and respectful of dignity. Recent controversies highlight the dangers of overreach—lifetime bans without hearing, humiliating public exposure, and unequal application of sanctions.

To preserve confidence in its aviation system, Nigeria must ensure that its skies are governed not only by rules of safety but also by the rule of law.

Tariffs, defined as taxes imposed on imported goods, serve as significant tools in international trade and economic policy. Governments worldwide employ them for various reasons, ranging from protecting domestic industries to generating revenue and addressing trade imbalances. Understanding the global order of tariffs and recent trends is crucial to analyzing their impact on specific nations like Nigeria, which actively participates in the global trading system.

The International Order of Tariffs:

The modern international tariff system largely took shape after World War II with the establishment of the General Agreement on Tariffs and Trade (GATT) in 1947, which aimed to reduce trade barriers. This evolved into the World Trade Organization (WTO) in 1995, which now oversees international trade rules, including those related to tariffs. Key principles underpin this order:

  • Most-Favoured-Nation (MFN) Principle: WTO members must apply the same tariff rates to all other WTO members, with exceptions for specific trade agreements.
  • National Treatment: Imported goods should be treated no less favorably than domestically produced goods once they clear customs.
  • Tariff Binding: WTO members commit not to increase their tariffs beyond agreed limits, providing predictability in international trade.

Tariffs can be structured in different ways, including ad valorem tariffs (a percentage of the product’s value), specific tariffs (a fixed fee per unit), and compound tariffs (a combination of both). While the WTO provides a framework, regional trade agreements (RTAs) like the European Union (EU) and the African Continental Free Trade Area (AfCFTA), as well as bilateral agreements, also play a significant role in shaping tariff landscapes by often reducing or eliminating tariffs among member countries.

Recent Global Tariff Actions and Trends:

In recent years, there has been a notable resurgence of protectionist measures, with tariffs being increasingly used as political tools. The administration of former U.S. President Donald Trump implemented several rounds of sweeping tariffs between 2018 and 2020, citing an “America First” doctrine aimed at reducing the U.S. trade deficit and reviving domestic industries. These actions, particularly the trade war with China involving tariffs on hundreds of billions of dollars worth of goods, disrupted global supply chains and triggered retaliatory measures from affected countries.

More recently, on April 2, 2025, President Donald Trump announced another series of sweeping tariffs on various countries, designating the day as “Liberation Day”. These tariffs, based on the principle of reciprocity, aimed to match tariffs imposed by other countries on U.S. exports and promote domestic manufacturing. Notable examples include:

  • A 34% tariff on Chinese imports.
  • A 20% tariff on EU goods.
  • Significant tariffs on Vietnam (46%), South Africa (30%), Switzerland (31%), Taiwan and Indonesia (32%), Cambodia (49%), Japan (24%), South Korea (25%), and India (26%).
  • A minimal 10% tariff on imports from the United Kingdom, Singapore, and Brazil, reflecting relatively balanced trade.
  • A 25% tariff on all imported cars, aiming to bolster the domestic automotive industry.

These tariffs led to sharp declines in U.S. stock indices and raised fears of stagflation and a potential recession. China retaliated with a 34% tariff on all U.S. imports and implemented export controls on rare earth minerals. The European Union and other affected nations also expressed strong opposition, warning of severe consequences for global trade and economic stability. Economists cautioned that these tariffs could lead to increased consumer prices, disrupted supply chains, and heightened risks of a global economic downturn.

The long-term effects of such tariffs are debated. While proponents argue they could boost domestic manufacturing and provide negotiation leverage, critics point to likely negative effects like higher consumer prices, retaliation from other countries hurting exporters, stock market volatility, and supply chain disruptions. Historical examples, such as the Smoot-Hawley Tariff in 1930, which worsened the Great Depression, serve as cautionary tales.

Nigeria’s Tariff Regime:

Nigeria employs both local and international tariffs as key instruments of economic policy.

  • Local Tariffs: These include the Value Added Tax (VAT) at 7.5%, excise duties on specific goods (alcohol, tobacco, etc.), customs processing fees, and import substitution tariffs designed to encourage local production.
  • International Tariffs: These are primarily administered by the Nigeria Customs Service (NCS) and include import duties ranging from 0% to 35% aligned with the Common External Tariff (CET) of the Economic Community of West African States (ECOWAS). While less common, export duties may be applied to prevent domestic shortages. Other international tariffs include trade facilitation fees like the ECOWAS levy and protective tariffs on goods like rice and vehicles to shield domestic industries.

The policy objectives of tariffs in Nigeria include revenue generation, industrial protection, economic diversification away from oil dependency, and trade regulation. The NCS contributes significantly to Nigeria’s non-oil revenue through tariffs.

Impact of Global Tariffs on Nigeria:

Nigeria, as an active participant in international trade, is inevitably affected by global tariff trends and specific tariff actions undertaken by major trading partners. The sweeping tariffs announced in 2025, while not directly targeting Nigeria with exceptionally high rates (a minimal 10% tariff is applied reflecting relatively balanced trade), can still have indirect consequences:

  • Increased Cost of Imports: Even a 10% tariff on goods from key trading partners like the UK, Singapore, and Brazil can increase the cost of these imports for Nigerian businesses and consumers. The 25% tariff on imported cars globally could also impact the Nigerian automotive market.
  • Disruption of Global Supply Chains: Broader global trade tensions and tariffs on major economies like China and the EU can disrupt global supply chains. Nigerian businesses that rely on components or raw materials sourced from these regions may face higher costs and logistical challenges.
  • Impact on Export Markets: Retaliatory tariffs imposed by countries like China on U.S. goods demonstrate the potential for trade disputes to escalate and affect global demand. While Nigeria may not be directly involved in these specific disputes, a general slowdown in global economic activity due to widespread protectionism could reduce demand for Nigerian exports, particularly raw materials and agricultural products.
  • Increased Protectionist Pressures: The trend of major economies resorting to tariffs might create pressure on Nigeria to adopt more protectionist measures for its own industries, potentially contradicting its commitments under free trade agreements like AfCFTA.
  • Challenges for Regional Integration: While Nigeria is a key member of ECOWAS and actively engaging with AfCFTA to reduce intra-African tariffs, global protectionist trends could complicate these regional integration efforts by creating external pressures and uncertainties.

Nigeria’s own tariff regime faces challenges such as smuggling, trade disputes, inflationary pressures from high import duties, and policy uncertainty. Navigating the complexities of the global tariff landscape while addressing these domestic challenges requires a coherent and well-calibrated trade policy.

Conclusion:

Global tariffs are a complex and dynamic aspect of international trade with significant economic and political ramifications. The recent surge in protectionist measures and the imposition of sweeping tariffs by major economies create an environment of uncertainty and potential disruption for global trade flows. While Nigeria is not a primary target of the most recent major tariff actions, it is not immune to their indirect effects, ranging from increased import costs and supply chain disruptions to potential impacts on export markets and regional integration efforts. Effectively managing its own tariff regime while navigating the evolving global landscape is crucial for Nigeria to achieve its economic development goals and improve the welfare of its citizens.

Historically, one of the earliest known codified systems of laws was the 285 laws established by a Babylonian king, Hammurabi of Mesopotamia, in the 18th century. These codified laws primarily addressed issues relating to marriage, sexual offenses, criminal sanctions, punishment, and interpersonal relationships. However, as society evolved, more complex and sophisticated laws were enacted, which made interpretation and application more difficult and cumbersome, thereby demanding a legally proficient approach.

It’s against this background that those who interpret and apply laws needed to be specifically qualified through specialized training and studies. Those with this special training in laws became what we today know as lawyers. In modern-day practice, lawyers do more than the earliest orators of ancient Athens. They solve complex issues and disputes for governments, corporations, businesses, and individuals.

A lawyer’s job is to help with understanding the law and how it affects the rights of the common person as well as the government. However, some people have continued to abuse and misuse the laws to their advantage, which is a potent reason why, across many societies today, lawyers are given bad publicity and perceived as crooked, untruthful, and compromising. But this is not true of every lawyer.

It was the great playwright Shakespeare who, in Henry IV, first suggested that killing all the lawyers was the solution to society’s problems at the time. This confirms the nasty things people often say or think about lawyers. Some even habitually ask in local parlance, “wetin lawyers dey do sef” – What special things do lawyers even do?

Another reason lawyers are associated with a bad reputation is that their work often involves settling conflicts and disputes, which means balancing diverse interests and perceptions. Hence, to mitigate negative perceptions and criticisms from society, in 2001, the national director of the American Lawyers Public Image Association (ALPIA), Nader Anise, a legal marketer, established Love Your Lawyer Day to appreciate lawyers and all they do on the first Friday of November each year. The day aims to promote public support for lawyers and judges by presenting them in a more positive light.

Today’s celebration differs from International Be Kind to Lawyers Day, created in 2008 by an American public speaker, Steve Hughes, and celebrated every year on the second Tuesday of April. In recognition of lawyers’ unsung contributions to society’s development and betterment, today (first Friday of November) is set aside internationally to celebrate Love Your Lawyer Day.

There are practical ways to celebrate this year’s Love Your Lawyer Day. Primarily, lawyers yearn for kindness from society. Lawyers generally have very stressful jobs and deal with strife all day. You can organize a sporting event or outing with a lawyer and get your friends involved. Did you know that watching a good law-related movie could affect your perception of lawyers? Organize a movie night where you and your friends watch one of the many excellent lawyer movies available. If movies aren’t your thing, read a good book and discuss it with your friends.

Another important way to celebrate this year’s Love Your Lawyer Day is to stop making lawyer jokes. In order to build up the reputation of lawyers, we need to stop being negative about them. This could start with leaving off the lawyer jokes and treating any lawyer friend with respect. This should not be hard to do. Just stop the lawyer bashing or jokes for a day. It will definitely be appreciated.

Besides, make donations in celebration of lawyers today. One of the most effective ways to celebrate Love Your Lawyer Day is to donate to a charity organization that helps make the world a better place, such as a charitable legal aid foundation, in honor of these legal warriors. Above all, pay your lawyer appropriate and reasonable fees for services rendered to support their economic well-being, living standards, and practice. To demonstrate your love for your lawyer, send them a gift basket or write them a card to express how much they mean to you. If you have ever been helped by a legal practitioner, use Love Your Lawyer Day to celebrate a lawyer for all they have done.

Above all, say “thank you” to a lawyer today. For those who have benefited personally from a lawyer’s service and would like to go the extra mile, go ahead and reach out to your lawyer, or any lawyer if you don’t have one, and appreciate them for the services they render every day. Pick up your phone now and call that lawyer today. Send a mail, message, or tweet to remind them that the valuable and productive long hours and dedication to justice are never taken for granted. And I believe that since you’re just calling to say thank you, they shouldn’t send you a fee note after the call for the time spent.

You may be interested to ask, why is Love Your Lawyer Day observed? It is to help put lawyers in proper perspective. For a profession perceived to be filled with liars, compromisers, double standards, and corruption, this day helps correct the wrong assumptions about them. Many of them do a lot of good, and more people do not get to realize that.

Very close to the above is the leeway the day provides to thank and appreciate lawyers for their services and contributions to society. We get to value and appreciate lawyers for all the good work they do on this day. This will further encourage them to continue making positive contributions through their profession.

Observing this day in celebration of lawyers also helps increase our knowledge of the law. This day gives us insight into the law profession. It helps us understand legal matters and maybe learn some legal jargon during interactions with lawyers.

While the Love Your Lawyer Day celebration started in America and has since become a global celebration across various countries, it is observed that the Nigerian legal community has not really been paying attention to this day since its creation in 2001. It is therefore recommended here that the Nigerian Bar Association and other relevant stakeholders within the Nigerian legal profession should intentionally recognize and celebrate Love Your Lawyer Day every year. This celebration could be incorporated into the yearly program and activities of the legal profession in the country, aiming to repair the now-battered image of the profession and reminding people that without lawyers, citizens and indeed society would lack guidance in navigating the complex world of law.

 

Love Your Lawyer Day, also referred to as World Lawyers Day, is celebrated annually on the first Friday of November. It was established by the American Lawyers Public Image Association (ALPIA) in 2001 to honor lawyers and promote a positive public image of the legal profession.
